What is small claims court?

Small Claims Court is a court in North Carolina that allows individuals to seek redress for monetary losses that are less than $5,000, such as unpaid rent, property damage, or breached contracts. It is a less expensive and less formal court than regular civil court and is designed to resolve disputes quickly and inexpensively. In Small Claims Court, an individual can file their complaint and then the other party will be served with a notice of the lawsuit. This notice must be served within 30 days of filing the complaint. After the defendant is served, both parties can submit evidence and the judge will hear arguments from both sides.
