What is small claims court?

Small Claims Court is a special court in South Carolina where people can bring claims of up to $7,500. In this court, you can bring civil cases that involve a dispute over money. These cases are usually much simpler and less complicated than other types of civil cases. In Small Claims Court, you do not have to have an attorney represent you, and there are no jury trials. The judge makes the decision about who wins the case and how much money is awarded. It is important to remember that if you do not follow the judge’s ruling, then you could be charged with contempt of court. Many people choose to use Small Claims Court because it is generally less expensive than going to regular court. The process is also much simpler and less time consuming. In addition, in many cases you do not have to pay court costs or pay for an attorney’s fees. Small Claims Court is a good option for people who have a dispute over money, but it is important to remember that it is not a substitute for legal advice. If you have a dispute that is more complicated or involves more money than Small Claims Court can handle, then it is important to seek out advice from a lawyer.
