How much does it cost to file a claim in small claims court?

In Colorado, the cost to file a claim in Small Claims Court depends on the amount of money the plaintiff, or person filing the claim, is seeking to recover. For claims under $7,500, the filing fee is $30.00. Claims over $7,500 typically require a $60.00 filing fee. Additionally, there may be court costs for serving documents to the opposing party. A Small Claims Court case can be initiated by filing an affidavit and a claim form. The affidavit is a form which requires the plaintiff to swear under oath that their claims are valid, and the claim form includes information about the case and the parties involved. Once the forms have been submitted and the filing fees have been paid, the court will assign a date for a hearing. The hearing may be done in person or, in some cases, by telephone. The filing fee is a cost to initiate a case in Small Claims Court, and it is not refundable. If the plaintiff is successful, the filing fee can be included in court costs which the defendant must pay. However, if the plaintiff is unsuccessful, the court will not reimburse the filing fee. When filing a Small Claims Court claim, a person should be aware of the potential costs both to initiate and close a case.
