How does small claims court handle appeals?

In Indiana, small claims court is a division of the circuit court, and it is designed to help resolve disputes between individuals or businesses over relatively small amounts of money. Appeals from small claims court decisions are handled in the same way as those from other court divisions. If a party does not agree with a decision made in small claims court, they can appeal the case to the circuit court. This must be done within thirty (30) days from the date of the small claims court judgment. The appeal must be filed with the clerk of the county court in the county in which the original small claims court hearing was held. Once the appeal is filed, the losing party can file a motion to have the case heard before the county court. Alternatively, if no motion is filed then the judge will determine whether the case should be heard by the county court. If the county court accepts the case, the parties must appear before the court and explain their respective positions. The parties must also submit evidence and testimonies in the same manner as if they were in the small claims court. After listening to all the evidence and testimonies, the county court will then make a decision and issue a final judgment on the case. This judgment is not appealable and must be followed by both parties.
