Can I request a jury trial in a small claims court case?
In the state of North Carolina, it is not possible to request a jury trial in a small claims court case. Small claims court is an informal court process that typically involves two individuals or two companies that have a dispute regarding an amount of money that is generally less than $15,000. This type of dispute is usually resolved in a quicker and less-expensive manner than going to a regular court trial. Because the amount of money involved is typically small and the proceedings of small claims court are informal and more relaxed than in a regular court trial, jury trials are not allowed. In North Carolina, both parties to the dispute are allowed to bring in witnesses and present evidence to support their case but no jury members are present. The court case is adjudicated by a judge and both parties are given the opportunity to make their argument. Once all evidence and evidence is presented, the judge makes a ruling. The ruling of a small claims court judge has the same authority as a jury trial ruling and can determine who is at fault in a dispute as well as the amount of money that is awarded to the party that prevails in the case. Therefore, in summary, it is not possible to request a jury trial in a small claims court case in the state of North Carolina since the proceedings are informal and not as legally binding as a regular court trial.
