What happens if I disagree with the decision in a small claims court case?

If you disagree with the decision made in a small claims court case in Delaware, you have the right to appeal the decision. In order to do this, you must file a Notice of Appeal to the Superior Court within 30 days of the final judgment in the small claims court. Once you have done this, the Superior Court will set a hearing date and time to hear your appeal. At the hearing, the Superior Court will consider evidence and testimony that was not heard during the small claims court case. The Superior Court will then make a new decision based on this evidence and testimony. This decision is binding, and you must accept it and comply with the ruling. If you are unhappy with the decision made by the Superior Court, you can file an appeal in the Delaware Supreme Court. However, this is only allowed in very rare circumstances and requires the permission of the Supreme Court. If the Supreme Court denies your appeal, the decision made in the Superior Court is final. It is important to remember that if you decide to go the appeal route, you should seek legal advice from an attorney or other qualified legal member. The process of appealing a small claims court decision is complicated and can become a lengthy and costly process.
