Can I appeal a ruling of a small claims court judge?
Yes, you can appeal a ruling of a small claims court judge in Wisconsin. In order to appeal, you must file a notice of appeal within twenty days after the court has entered judgment, or within twenty days after the court has granted your motion for a new trial, whichever is later. After filing your notice, you then need to file a notice of appeal with the office of the clerk of the circuit court for the county in which the small claims judgment was rendered. Within 45 days from the date of filing your notice of appeal, you will need to pay a required fee and give a copy of your notice of appeal to all parties involved in the original case. Your appeal will be heard in the circuit court of the county in which the small claims judgment was rendered. At the hearing, the circuit court judge will re-examine the facts and evidence in the case and issue a new ruling on the matter. If you are not satisfied with the ruling of the circuit court judge, you may appeal to the court of appeals of the state of Wisconsin. If the court of appeals issues a ruling that you disagree with, you may then file a petition for review with the Wisconsin Supreme Court. The Wisconsin Supreme Court has the power to review the decisions of the court of appeals and may modify or reverse their decision.
