Who can testify in a small claims court case?
In Delaware, small claims court is a place for people to resolve disputes in a simpler, faster, and less expensive way than traditional court proceedings. Generally, the types of cases heard in small claims court involve disputes over money, property, or services. In Delaware, the types of people allowed to testify in a small claims court case include people involved in the dispute as well as people who have relevant knowledge of, or experience with, the case. This includes parties to the court case (those making the claim and those defending against it), as well as witnesses. Witnesses can be anyone who has knowledge of the dispute or was present when something occurred related to the dispute. A minor over seven years of age may be called as a witness in a small claims court case if the minor understands the obligation to tell the truth. If a party wishes to call a minor under seven years of age, the court may allow it if it feels it is necessary for the case. In addition, an expert witness may also be called to testify in a small claims court case in Delaware. Expert witnesses are people who have particular knowledge on a subject related to the case. Their expertise may help the court make its decision. Expert witnesses may be called by either party. Finally, the court may allow a person to testify by telephone or other remote means if necessary. This may be especially useful if the witness is far away from the court or has health problems preventing them from appearing in court.
