Are there any restrictions on the type of evidence I can submit in a small claims court case?

In South Dakota, small claims court cases are governed by the South Dakota Codified Laws. In particular, sections 15-39-11 and 15-39-12 set forth rules for what evidence may be admitted in small claims court cases. Generally, the court may accept any evidence that is relevant and specific to the case. Relevant evidence includes eyewitness testimony, physical evidence, expert opinions, bills and receipts, contracts, and any other evidence that is related to the case. The court may also accept written evidence, such as affidavits or sworn statements. Additionally, the court may accept documentary evidence, such as photos, video recordings, or other recordings (e.g., audio recordings). Evidence that is not allowed in small claims court includes hearsay evidence (e.g., witness testimony about what others have said) and evidence that is not directly related to the case. Furthermore, the court may not accept witnesses or evidence that are identified solely through reputation or hearsay. Such evidence may be disregarded, or the court may deem it as insufficient and inadmissible.
