How do I file an answer to a complaint filed in small claims court?

In Florida, filing an answer to a complaint filed in Small Claims Court is a straightforward process. The first step is to obtain copies of the complaint and summons from the Clerk of the Court. The summons lists the date, time, and place of your hearing. Once you receive the documents, you must fill out a form called an Answer. This form must be legible, typed, and signed in front of a notary public or two witnesses. You must include your name, address, contact information, and the case number on the form. The Answer is due not later than the date and time listed on the Summons. You must then file your Answer with the Court. You can mail it, fax it, or deliver it in person to the Court Clerk’s office. When filing your answer, you must also have a copy of the complaint and summons. In your Answer, you must state details and facts explaining why you do not agree with the Plaintiff’s complaint. If you disagree with any of the facts stated in the complaint, explain why and list your own facts and evidence. In your Answer, you must also state what type of relief, if any, you are seeking from the court. Once you have filed your Answer, the Court will set a hearing date. At the hearing, you must appear for a hearing where you can present your case.
