How do I collect a small claims court judgment from a business?
If you have won a judgment against a business in Small Claims Court in California, you have various options for collecting the money from them. First, you can try to obtain a payment plan or settlement agreement with the business. You may be able to negotiate a payment plan in which the business pays you the money over a set period of time, or work out a settlement agreement in which the business pays you less than the full amount you are owed. If the business refuses to cooperate in setting up a payment or settlement plan with you, you may be able to collect the money through wage garnishment. You can file a wage garnishment order with the court, which will order the business to take money directly out of their employees’ paychecks and send it to you. Finally, you may be able to obtain a bank levy, which would seize the funds from the business’s bank accounts. Before you take this step, you must alert the business and give them a chance to respond, and you must also file a debtor’s examination to determine where the business has money. Each of these steps require forms to be filled out and filed correctly with the court, so if you need help collecting your judgment, it’s a good idea to work with an experienced small claims attorney.
