What is the process of obtaining a judgment in a small claims court case?

In Massachusetts, obtaining a judgment in a small claims court case is a several step process. First, the person who has been wronged, called the plaintiff, must write and file a statement of claim with the small claims court. This statement should include the details of the case, such as why the defendant should be held responsible for the money or property owed, and how much the plaintiff is claiming. Next, the plaintiff must make sure that the defendant is served with a copy of the statement of claim. This can be done in several ways, such as by a sheriff’s office, or by mail. Once this is done, the defendant has 28 days to file a response to the statement of claim. The next step is for the court to hold a hearing. At the hearing, the small claims court judge will listen to both sides of the case. During the hearing, both parties will need to provide evidence to support their claims. After hearing both sides of the argument, the judge will make a ruling on the case and enter a judgment for the plaintiff or the defendant. If the plaintiff is victorious, they will be awarded a sum of money or other award to compensate for the damage caused by the defendant.
