How do I obtain a default judgment in a small claims court case?
In Washington, the process to obtain a default judgment in a small claims court case is relatively straightforward. In order to obtain a default judgment, you must first file a Complaint with the small claims court. This Complaint should include the specific details of your claim including why the other party should be held liable. Once the Complaint is filed, the court will arrange to have a copy served to the defendant. The defendant then has a certain number of days to respond to the court either by making an appearance or filing an Answer. If the defendant fails to do either, you may file a motion asking the court to enter a default judgment. The motion will include a statement of the claim and a request that the court enter the judgment in your favor. Once the motion is filed, the court will issue a judgment if it is satisfied that the Complaint adequately states your claim. Finally, after the default judgment is issued, you will need to collect on the judgment. This process may require that you obtain a Warrant of Distraint to force payment. If the defendant fails to comply with the debt payment requirements and continues to be non-compliant, you can file an Order of Enforcement to recoup the debt.
