How much does it cost to appeal a small claims court decision?

In Kansas, the cost of appealing a small claims court decision depends on the amount of the judgment. If the amount of the judgment is less than $4,000, an appellant must pay a filing fee of $125 and an appellate fee of $125, both payable to the district court clerk when the appeal is filed. If the amount of the judgment is $4,000 or more, the filing fee is $125 but the appellate fee is one-half of 1% of the amount of the judgment. For example, if the judgment is $8,000, the appellate fee is $40. In addition to the fees, the appellant may also be required to pay the cost of a transcript of the proceedings in the small claims court, which may vary in cost. The appellant is also responsible for filing a statement of issues to be considered by the appellate court. Once the appeal is filed, the appellate court will set a hearing date for both parties. The appellant should anticipate additional costs associated with the appeal, such as preparation of an appellate brief, court reporter costs, and witnesses’ fees and expenses.
