What is the process for appealing a small claims court decision to a higher court?

In Maryland, appealing a small claims court decision to a higher court can be done in two ways. First, either the plaintiff or defendant may file a “motion for a new trial.” In a motion for a new trial, the individual claims that the judge did not follow the law or made an error in the decision. The individual must file the motion within 30 days from the date of judgment, and a hearing will be set by the court. At the hearing, the individual has the opportunity to explain why the judge made an error. If the court agrees, it will grant a new trial. The second option is to file an appeal with the Circuit Court. The individual may appeal the small claims court’s decision within 30 days of the judgment being rendered. In the appeal, the individual must explain why the small claims court judge made an error. However, an appeal will not reverse the lower court’s decision until the Circuit Court rules on the appeal. If the Circuit Court agrees with the plaintiff or defendant, it will overturn the lower court’s judgment. If the Circuit Court disagrees, the small claims court’s decision will stand as it is.
