What is the process for appealing a small claims court decision to a higher court?

In New York, if a party is unhappy with the decision of a small claims court, they are able to appeal the decision to a higher court. In order to do so, the unsatisfied party must file a Notice of Appeal with the court within 30 days of the court’s ruling. Along with the Notice of Appeal, the unsatisfied party must submit a fee and may also be required to provide a bond or security. The court will review the Notice of Appeal and determine whether the party has a right to appeal. If the court determines there is a valid appeal, the unsatisfied party will receive a copy of the record of the small claims court decision. The record contains all the information the higher court will need to review the case. The unsatisfied party must then file an Appellant’s Brief, which includes arguments for why the court should overturn the small claims court decision, with the higher court. Both parties can submit additional evidence, if necessary. The higher court will then review all of the information in the record and the parties’ briefs. The court will make a decision to either overturn the small claims court decision or uphold it. The decision of the higher court can be appealed to an appellate court, if a party isn’t happy with the result, but this can be expensive and time-consuming. Therefore, it is best for parties to work out any disputes in small claims court in order to avoid the appeals process.
