What is the process for appealing a small claims court decision to a higher court?

In West Virginia, the process for appealing a small claims court decision to a higher court is similar to the appeals process in other states. First, the appellant must file a Notice of Appeal within thirty days of the small claims court’s decision. The Notice of Appeal must be filed with the clerk of the small claims court and the opposing party and a copy must be served to the other party. In addition, the appellant must pay a fee to the clerk of the small claims court prior to the filing of the notice of appeal. Once the Notice of Appeal is filed, a transcript of the proceedings must be prepared and submitted to the court, along with a copy of the Notice of Appeal. The appellant must also file a brief with the court, which explains the reasons why they are appealing the small claims court decision, as well as any arguments that support their position. Once the appellant has submitted the brief, the opposing party will have the opportunity to submit a brief of their own. After both parties have submitted their briefs, the court will hold a hearing to evaluate the arguments of the parties and issue a ruling. If either of the parties disagree with the ruling, they still have the option to appeal to a higher court, such as the West Virginia Supreme Court.
