How can I hold the school board responsible for the school bus accident?

In New Jersey, the school board can be held accountable for a school bus accident under the law of negligence. Negligence is when someone is careless and fails to exercise reasonable care to prevent foreseeable harm. In order to establish negligence on behalf of the school board, the plaintiff must prove that the school board had a legal duty to exercise care, that the school board breached this legal duty, and that the breach of the duty was the actual and proximate cause of the harm suffered. The school board may be liable if it can be shown that the school board was negligent in its hiring and training of the driver, or in its maintenance of the bus. To prove that the school board was negligent, the plaintiff must provide evidence that the school board knew or should have known about the dangerous condition of the bus or the driver’s inadequacy, and that this condition or inadequacy caused the accident. The plaintiff must also prove that the school board took no action to prevent the accident from happening. The school board may also be liable if a policy or regulation was violated. For instance, if the school board had a regulation about the number of children in a bus, and the bus had too many children in it that caused or contributed to the accident, then the school board may be held responsible. Ultimately, any claim of negligence against the school board must be based on evidence that the school board did not take reasonable steps to prevent the accident. If the plaintiff’s evidence is strong enough to show that the school board was negligent, then the school board may be held accountable for the school bus accident.
