What is student defense law?
Student defense law is a type of civil law in North Carolina that provides protection to students when they are facing criminal charges or discipline from a school. Student defense law applies to all public, private, and charter schools in North Carolina. Under student defense law, students have the right to due process in any disciplinary proceedings, which includes being able to appeal any disciplinary action and have representation from a lawyer if they wish. In addition, student defense law prevents school administrators from imposing draconian punishments, such as out-of-school suspensions, without proper cause. Student defense law also affords students additional rights and protections. For instance, students have the right to be informed of the charges being brought against them so they can prepare an appropriate defense. In addition, students have the right to a neutral hearing where both parties can present evidence and call witnesses. Student defense law is designed to empower students and provide them with more protection in the face of disciplinary actions or criminal proceedings. It is important for students to be aware of their rights in order to ensure that they are treated fairly and equitably.
