What is the appeals process for student defense cases?

The appeals process for student defense cases in Alaska is based on the court system of the state and varies depending on the type of case. In general, after a decision is made in the case, either party may appeal the decision to the Alaska Supreme Court on the basis that the lower court erred in its decision. In order for an appeal to be considered, the party filing the appeal must file a Notice of Appeal with the court which issued the decision. The Notice of Appeal must include a statement of the facts, a statement of the decision being appealed, and a statement as to why the court’s decision is incorrect. If the Notice of Appeal is accepted by the court, the appellant will be required to file a Memorandum of Law which will set forth the legal arguments in support of the appeal. Once the appellant has filed the Notice of Appeal and Memorandum of Law, the Supreme Court will determine whether the appeal has been properly and timely filed and whether or not the appeal presents a substantial legal question. If the appeal satisfies the Supreme Court’s criteria, the Court may grant a hearing for oral arguments. After the oral arguments are presented, the Court will issue a written opinion, either affirming or reversing the lower court’s decision. However, if a party believes that the lower court erred in its decision, they may choose to appeal the decision and have their case heard by the Supreme Court.
