What is the appeals process for student defense cases?
The appeals process for student defense cases in California is the same as most other types of civil or criminal legal proceedings. Generally, if a student is found guilty of a violation and/or subsequently given a penalty, they can file an appeal to have the decision and/or penalty overturned. An appeal is a request to a higher court to review the decision of a lower court. In California, an appeal must be filed within 6 months of the original ruling or penalty. The appeal must be filed with the court of appeals for the circuit in which the original case was heard. The student filing the appeal will typically provide an argument (known as a “Brief”) as to why the original decision should be overturned. This argument must be filed with the court of appeals. The court of appeals may decide to consider the argument and schedule oral arguments (if the student, or the school district, requests them) or they may decide to not consider the argument. If the court of appeals decides to consider the argument, they will then render a decision on the appeal and either uphold or overturn the original decision and/or penalty. Depending on the nature of the appeal, either party can still pursue further appeals depending on the final outcome. The appeals process for student defense cases in California is ultimately designed to provide students with the opportunity to challenge the original ruling and penalty by requesting a review from a higher court.
