What is the proper procedure for filing a student defense complaint?
If you believe that you have experienced mistreatment in the form of a student defense issue, the State of Florida has a process in place to file a student defense complaint. First, you must document any evidence that you feel supports your claim. This may include testimonies, photographs and/or videos of the incident in question. Additionally, it may be beneficial to gather any information that may be used in a potential hearing, such as documents and records of any previous issues you may have had with the school. Once you have gathered your evidence, you must submit a written complaint to the Florida Department of Education. The complaint must be sent to the address given in the Education Statute 1000.41. The complaint should include your name, contact information, details of the student defense issue, and any evidence or documents you have collected. After you submit the written complaint, the Florida Department of Education will review and investigate the issue. If the Department of Education decides that there may be grounds for a student defense complaint, they will contact the school accused of the mistreatment. The school will be given an opportunity to respond and present their own evidence. Finally, a hearing will be held if the Department of Education finds sufficient evidence to move forward with the student defense complaint. During the hearing, you will have the opportunity to present your evidence and witnesses. After all evidence has been heard, the Education Statute 1000.41 will be used in assessing the situation and determining a resolution.
