How does the university decide on a penalty in a student defense case?

In Hawaii, universities must take a number of factors into consideration when deciding on a penalty in a student defense case. The university must evaluate the conduct in question and consider the student’s prior disciplinary record (if applicable), the severity of the misconduct, the potential for harm to other university members, and any mitigating or aggravating circumstances surrounding the violation. The university may also consider the overall impact of the misconduct on the university’s purpose, mission, and core values. Once the university has determined the applicable policy and a potential penalty, the student will be notified and given the opportunity to accept responsibility and the associated penalty. In situations where the student disputes responsibility, the university will allow the student to present their case before a hearing body comprised of university officials, which may include faculty members, administrators, and/or student leaders. This body is responsible for making a determination of responsibility and a recommendation of a penalty to the university. The university will weigh the recommendation of the hearing body with the facts and circumstances of the case in coming to a final decision on the penalty. Penalties may range from a warning and community service hours, to suspension and/or expulsion from the university. Ultimately, the university makes the final decision on the penalty.
