Who can I hold liable if I'm injured in a ski lift accident?
In Utah, if you are injured while using a ski lift, you may be able to hold liable any of the following parties: the ski resort, the lift manufacturer, the ski resort’s employees, and/or the lift operator. All of these parties must adhere to certain safety regulations in order to ensure the safety of the skiers. The ski resort is responsible for properly constructing and maintaining the ski lift and for the overall safety of the lift. The lift manufacturer is equally responsible for ensuring the lift is designed and constructed in a safe manner and with quality, safe components. Employees of the ski resort must be properly trained in the use of the lift and must adhere to any safety protocols that are in place. The lift operator plays a key role in ensuring the proper functioning of the lift and is obligated to follow any safety protocols in place. If any of the aforementioned parties are negligent and fail to adhere to safety regulations while constructing, maintaining, operating, or using the ski lift, and you suffer an injury as a result, you may be able to hold them liable for your injuries. It is important to consult an experienced lawyer to ensure your rights are protected and to receive the necessary legal representation.
