Who is responsible for ski area maintenance after a ski accident?
In California, ski area maintenance following a ski accident is the responsibility of the ski area operator. Under the Ski Safety Act of 2004, ski area operators are required to make sure that their ski areas are maintained according to all applicable laws, ordinances and regulations. This includes taking all reasonable measures to maintain the ski area in a safe condition. In order to be considered “safe,” a ski area must be designed, constructed, operated, maintained and inspected in a manner that minimizes the risks of injuries to skiers, and it must adequately comply with all applicable laws, ordinances and regulations. Ski area operators are responsible for regular inspection and maintenance of all ski area components, including chairlifts, runs, ski-related equipment, ski lifts, and other equipment. When an accident occurs, the ski area operator is responsible for fixing or replacing any damaged or broken equipment, taking measures to prevent future accidents, and providing any necessary medical care to injured skiers. In addition, if any damage was done to the ski area, the operator is responsible for restoring the area to its pre-accident condition. It is important for ski area operators to remember their responsibility for ski area maintenance after an accident. If a ski area does not meet the requirements set forth by the Ski Safety Act of 2004, then the operator could be held liable for any injuries that result from their negligence.
