What are the legal implications of a slip and fall accident?
Slip and fall accidents can have serious legal implications in Washington. In Washington, the legal system recognizes two main types of legal claims arising from slip and fall accidents: negligence, and premises liability. In negligence claims, the person who caused the accident must have acted in a manner that fell below a reasonable standard of care. For example, if a person slipped on a wet floor and it can be demonstrated that the owner knew that the floor was wet, but failed to take proper action to warn customers or to dry it, they may be considered negligent. In premises liability cases, the owner of a property is responsible for accidents that occur on their property, even if they were not negligent. Same as in the negligence claim, the person who slipped must have been injured due to a hazardous condition on the property, such as a wet floor or spilled liquid. In either claim, a person who has been injured due to a slip and fall may seek financial compensation from the responsible party. Damages can include medical bills, lost wages, and pain and suffering. Depending on the circumstances of the accident, the court may award punitive damages as a way to punish the responsible party and to discourage similar incidents from happening in the future.
