How are slip and fall cases proved in court?
A slip and fall case in Arizona must be proved in court to be successful. The plaintiff, or the person filing the lawsuit, must prove that the defendant (the person being sued) was negligent in causing the slip and fall accident. This means that the plaintiff must prove that the defendant somehow created an unsafe condition or failed to fix an unsafe condition that led to the accident. In order to prove negligence, the plaintiff must provide evidence which establishes that the defendant owed a duty to the plaintiff, that the defendant breached that duty, and that the breach of duty was the cause of the plaintiff’s injury. This can include photographs, testimony from witnesses, and documents related to the accident. Additionally, medical records can be used to prove the extent of the plaintiff’s injury and damages. The defendant may also have a duty to warn of a known, dangerous condition. If the defendant failed to do so, the court could find the defendant liable for the plaintiff’s injuries. The court also considers the actions of the plaintiff before, during, and after the fall. The court assesses if the plaintiff was acting in a safe manner and if he or she followed all safety rules in the area. Ultimately, each case is decided on a case-by-case basis, based on the evidence presented. The judge or jury then decides if the defendant was at fault and whether the plaintiff is eligible for compensation.
