What is the legal definition of a “trip and fall”?

In South Dakota, a trip and fall is defined as a type of personal injury wherein an individual trips or slips on a hazardous object or surface that was caused by the negligence of another party. This type of accident is usually a result of the negligence of a property or business owner in their responsibility to maintain reasonably safe conditions on their property or premises. In such cases, the victim may have the right to recover financial compensation for their injuries, including medical expenses, lost wages, and other damages. In order to prove that the slip or fall was the result of the negligence of the property or business owner, the victim must show that the hazardous condition was caused by the owner’s failure to maintain reasonable safety standards on the property. Furthermore, the victim must show that he or she was harmed as a direct result of the unsafe condition. Trip and fall cases may involve a wide range of hazardous conditions, including icy sidewalks, hazardous stairways, and improperly maintained walking surfaces. In each case, the victim must be able to prove that the condition was caused by the owner’s failure to maintain reasonable safety standards. Additionally, the victim must prove that he or she was harmed as a direct result of the hazardous condition. In some instances, an experienced attorney may be able to help the victim in proving negligence on the part of the property or business owner.
