How is “medical malpractice” different from sports injuries?
Medical malpractice is a type of negligence that occurs when a healthcare professional, such as a doctor or nurse, either fails to provide an acceptable level of care or provides care that fails to meet a basic standard of care accepted by the professional community. This could be providing poor advice or treatment that led to a patient’s injury, or failing to diagnose or treat a medical condition in a timely manner. Sports injuries, on the other hand, are injuries that occur due to physical activity or contact sports. These can include any physical injury that happens due to participating in a sport, such as a sprained ankle, concussion, or torn ligament. The main difference between medical malpractice and sports injury is that medical malpractice involves a health care professional’s failure to provide a standard level of care to a patient, whereas a sports injury occurs as a result of physical activity. Medical malpractice is usually seen as a legal wrong and can be the basis of a lawsuit, while a sports injury is usually seen as an unavoidable accident. In Washington, sports injuries may not constitute medical malpractice unless the injury was caused by the intentional actions of another player or the negligence of the coach or referee.
