What is the appeals process for Social Security disability and SSI claims?
The appeals process for Social Security Disability (SSD) and Supplemental Security Income (SSI) claims can be complicated, but there are usually four stages of appeal available in Illinois. The first step is to request a reconsideration, in which a different Disability Determination Services (DDS) representative than the one who made the initial denial will review the claim and make a new decision. If the appeal is unsuccessful, you can then request a hearing before an administrative law judge (ALJ) in the DDS office. During the hearing, you will have the opportunity to present your case, provide additional evidence, and/or testify. If the ALJ denies the claim, the next step is to file an appeal with the Appeals Council. This step involves requesting a review of the administrative law judge’s decision. If the Appeals Council approves the request to review, a different ALJ will review the case and make a new decision. If the claim is still denied, the final step is to file a civil lawsuit in a federal district court.
