How does spousal support change when the couple has children?
In Wisconsin, spousal support is determined based on a variety of factors such as the length of the marriage, each spouse’s earnings and earning potential, and the standard of living during the marriage. When a couple has children, however, the court will factor in the children’s best interests when deciding how much spousal support to award. When a couple has children, the court may weigh the needs of the children as being more important than the receiving spouse’s need for support. The court may factor in the costs of childcare, medical expenses, and any other costs associated with raising a child. The court may also consider whether either spouse has other financial resources in order to support themselves and any children. The court may also factor in the length of the parents’ marriage to the child. If the couple was together for a long time and the child was born late in the marriage, the court may determine that the paying spouse should provide more in spousal support for a longer period of time. On the other hand, the court may also determine that if the couple had a short marriage and the child was born early in the marriage, the paying spouse should provide less in spousal support for a shorter period of time. Ultimately, spousal support can vary depending on the individual circumstances of each couple when children are involved. The court will look at the factors previously discussed as well as any other relevant information in order to make a fair decision in the best interests of the children.
