When is spousal support not required in a divorce settlement?
In Washington, spousal support is not always required in a divorce settlement. In fact, there are certain conditions which must be met for spousal support to be required. Generally, spousal support is not required when both parties are able to support themselves on their own without the help of additional income from their partner. Additionally, spousal support is not typically required when the marriage is of a short duration (less than seven years) and both parties have not been cohabiting in the same household for a significant amount of time. Finally, spousal support may not be required if the other party has committed some sort of wrongdoing during the course of the marriage that has caused a significant financial hardship. In each situation, the court must consider a variety of factors, like the length of the marriage, the lifestyle of the parties, the age and health of each party, and the contribution of each party to the marriage, in deciding whether to grant spousal support or not. Ultimately, the court will make a decision based on what is in the best interest of both parties and what is fair and reasonable in the circumstances.
