What are the laws concerning the use of artificial intelligence?

The use of artificial intelligence (AI) in Maryland is governed by several laws. The Maryland Technology Development Corporation Act of 2012 established the Maryland Technology Development Corporation (TEDCO) to promote the development and use of AI in the state. The act also provides tax incentives to businesses that use AI to create jobs, generate revenues, and promote economic growth. The Maryland Department of Information Technology (DOIT) oversees the use of AI in the state and implements initiatives to ensure that businesses comply with industry standards. In 2019, the state enacted the Maryland Artificial Intelligence Development Act, which requires the DOIT to provide guidance to businesses that use AI and to report to the Maryland General Assembly on the use of AI and its effects on the economy, public safety, and overall societal impacts. The act also requires the DOIT to develop a plan to ensure the responsible use of AI and protect the privacy of citizens’ data. The Maryland Consumer Protection Act also applies to the use of AI in Maryland by requiring businesses to provide clear and conspicuous notice to consumers regarding the use of AI and how it affects their privacy. Businesses are also required to obtain consent from consumers before collecting, using, or sharing their data. Finally, businesses are prohibited from using AI in a way that is discriminatory, unfair, or deceptive.
