What are the laws concerning the use of internet of things technologies?
In New York, the laws concerning the use of internet of things technologies are numerous and complex. The internet of things (IoT) is a network of physical devices—such as sensors, appliances, and other connected devices—that can be controlled and monitored through the internet. The New York State Technology Law, § 208, defines the use of the internet of things technology and outlines allowable regulations. The law states that any person that "operates for any commercial purpose a device that is connected to the internet or any other network shall be responsible for taking all reasonable steps, including but not limited to the adoption of proper security measures, to protect the device from unauthorized interference or access, or from being used for illegal and criminal activities." The New York State Cybersecurity Requirements for Financial Services Companies, set forth by NYDFS 23 NYCRR 500, also governs the use of internet of things technologies. This rule requires financial institutions to secure all internet-connected devices that are within their possession or control. This includes establishing cyber security policies that address network security, customer data privacy, and incident response. Finally, the New York State Data Breach Notification Law sets forth strict guidelines for companies and organizations regarding the security and privacy of personal customer data gathered through the use of internet of things technology. The law requires that companies notify customers of a data breach within 72 hours of discovery. Companies must also provide identity protection services and a detailed timeline of the incident to affected customers. Overall, the laws governing the use of internet of things technologies in New York are designed to protect customers’ data and personal information. Companies must abide by these regulations in order to ensure the security of their customer data and networks.
