What are the laws concerning the use of drones in commercial activities?
In New York, the use of drones for commercial activities is regulated by the state government. The laws governing drone use in New York are outlined in Part 107 of the Federal Aviation Regulations. This regulation outlines the minimum requirements for commercial drone operators, as well as a series of safety regulations. For example, all drone operators must register their drone with the Federal Aviation Administration (FAA) before they can use it commercially. Drone operators must also prove that they have passed the FAA’s Small Unmanned Aircraft Systems (sUAS) test, and have a valid remote pilot certificate. They must also abide by the FAA’s minimum altitude, how fast the drone can fly, and how far away it can fly. Aside from the FAA regulations, New York State also has its own drone laws. These laws state that anyone operating a drone for commercial purposes must obtain a permit from the NYS Department of Transportation. This permit will allow operators to fly in a particular area. Furthermore, commercial drone operators must also adhere to the rules set forth by the New York Privacy Act. Under this law, all drones must remain at least 200 feet away from property owned by someone else, and no footage captured by the drone can be sold or transferred to a third party. Overall, commercial drone operators in New York must follow all federal and state regulations in order to operate legally. Failure to do so can result in fines, jail time, and even the confiscation of the drone.
