Are there any laws concerning the protection of trade secrets related to technology?
Yes, California has several laws that protect trade secrets related to technology. The most pertinent law is the California Uniform Trade Secrets Act (CUTSA). This law provides owners of valuable trade secrets the right to sue anyone who discloses or misappropriates their trade secrets. Under CUTSA, a trade secret can be any formula, pattern, device or compilation of information that can give a business an advantage over its competitors who do not have access to it. CUTSA offers both civil and criminal remedies when a trade secret has been stolen or disclosed. If a company’s trade secret is misappropriated, the company can seek monetary damages, including the profits earned by the other party as a result of the theft. In addition, the company may also be able to stop further disclosure and obtain an order for the destruction of information derived from the trade secret. CUTSA also imposes criminal penalties on anyone who knowingly misappropriates a trade secret. This includes a fine of up to $5,000 and/or up to one year in prison. In cases where the misappropriation is done for economic gain, stiffer penalties may apply. Overall, trade secret owners can have the peace of mind knowing that their valuable information and technology will be protected under California law.
