What is a trust amendment?

A trust amendment is a legal document used to change the terms of an existing trust. It is written agreement that allows a trustee to modify some or all of the conditions of a trust agreement. Amendments of a trust can be used to change the amount of an assets distribution, change the beneficiaries of the trust, or for many other purposes. In South Carolina, trusts are governed by South Carolina Code Title 62, entitled “Trusts and Estates.” This code section establishes the rules of trust formation and modifications in the state and sets forth the procedure for making a trust amendable. A trust amendment must be drafted by a qualified attorney and must be in writing for it to be legally valid. This document should clarify the changes made to the trust agreement and be signed by all parties involved in the trust. Once a trust amendment has been drafted, it should be reviewed by the current trustee. The trustee will then decide if the proposed changes are in the best interest of the trust’s beneficiaries before signing and notarizing the amendment. After the amendment is signed and notarized, it should be filed with the county clerk’s office and all beneficiaries should be informed of the changes. Trust amendments can be a useful tool for making changes to the terms of a trust agreement while still protecting the rights and interests of the trust’s beneficiaries. It’s important to understand the rules and regulations surrounding trust amendments and to have a qualified attorney draft any changes to ensure it is legally valid.
