What is a special needs trust?

A special needs trust is an important tool in California Trusts and Estates Law. The trust is specifically designed to provide financial support for a person with a disability or special needs, while still allowing the individual to qualify for certain benefits such as Social Security Income and Medicaid. The trust is commonly set up so that someone else, typically a family member, is created as the trustee, who is responsible for managing the funds in the trust. The trust makes it possible for someone with a disability to have access to funds for quality of life expenses, while still allowing them to continue to receive benefits that they would otherwise not be eligible for. For example, if someone with a disability has their own income or assets, then these might jeopardize their eligibility for Medicaid or SSI. A special needs trust enables them to receive these funds without having to worry about losing benefits. The trustee is responsible for various tasks, such as making sure that the beneficiary receives the funds from the trust, as well as ensuring that the funds are used appropriately for things like education, medical care, and other expenses. This can be important for ensuring that the beneficiary is able to maintain their quality of life. In addition to providing financial support, special needs trusts can also help protect beneficiaries from being taken advantage of, as the trustee is obligated to act in the best interests of the beneficiary. As such, the trust can be an important way to ensure the financial security of someone with a disability or special needs.
