What are the types of trusts?

Trusts are legal instruments that are used to hold and manage assets. In Texas, there are four common types of trusts: revocable living trusts, irrevocable living trusts, testamentary trusts, and charitable trusts. A revocable living trust is a trust created during the trustor’s lifetime and is revocable, meaning the trustor can modify or revoke the trust at any time during his/her lifetime. Unlike other trusts, a revocable living trust does not create a separate legal entity and the trustor remains in control of the trust assets. An irrevocable living trust is similar to a revocable living trust, but the trustor does not have the option of revoking or modifying the trust. The assets held by the irrevocable living trust are not considered part of the trustor’s estate, so they are not subject to the same taxes and other liabilities. A testamentary trust is created upon the death of the trustor and is funded with assets from the trustor’s estate. The trustor’s will or trust agreement outlines the terms of the trust, such as how the assets will be managed and who the beneficiaries are. Finally, a charitable trust is a trust created for charitable purposes, such as providing financial support to a charity or donating money to specific causes. These trusts are typically used to transfer assets to charitable organizations without the worry of paying taxation. Overall, having a trust is a great way to ensure that one’s estate is managed in a way that meets one’s wishes while avoiding taxes and other liabilities. Knowing the various types of trusts available in Texas is essential in determining which type of trust is most suitable for the trustor’s situation.
