How do I terminate a trust?
In the State of Washington, terminating a trust can be a complex and time consuming process, depending on the type of trust that has been established. Generally, in order to terminate a trust, the trustees must follow the rules of the trust document and the laws of the State of Washington. The first step in terminating a trust is for the trustees to gather all the necessary documents. This typically includes the original trust document, any amendments and/or restatements, and any applicable tax returns. With all the documents in hand, the trustees must review the provisions of the trust, to ensure they have complied with all the legal requirements. Once the trustees have reviewed the trust document, they should then consult the deed or the appointment of successor trustees. This will determine who will perform the duties required to terminate the trust. This can include notifying the beneficiaries of the termination, distributing remaining assets, and filing any required tax paperwork. The trustee must also determine if there are any outstanding debts or obligations that must be addressed. If so, the trustee will need to take steps to ensure that those obligations have been paid. Once the trustees have complied with all the provisions of the trust document and the laws of the State of Washington, they are then in the position to file a petition with the court requesting termination of the trust. The court will review the petition and all the documents submitted to determine if the termination will be approved. Once all the requirements have been met and the court has approved the termination, the trustees will be issued a discharge by the court, which serves as final proof that the trust has been terminated.
