What are the elements of a trust?
A trust is an estate planning tool that is designed to provide an individual or organization with control over the assets of an individual or organization. When a trust is established, the individual or organization that creates the trust is referred to as the trustor, settlor, or grantor. The trustor transfers assets to the trust and appoints a trustee. The trustee is responsible for managing the trust assets and must obey the law and adhere to the terms of the trust. The elements of a trust include the trustor, the trustee, the beneficiaries, and the trust property. The trustor is the person who creates the trust and transfers assets to the trust. The trustee is the person or entity appointed by the trustor to manage the trust. The beneficiaries are the people or entities that will receive distributions from the trust. Finally, the trust property are the assets that are transferred to the trust and managed by the trustee. The trust must meet certain legal requirements in order for it to be valid. In the state of Arizona, the trust must be in writing and signed by the trustor, who must be of sound mind and an adult. The trust must also include the names of the beneficiaries, the trustee, and the trust property. By establishing a trust, the individual or organization transferring the assets can control how the assets are used and ensure that the desired goals of the trust are met, even after the trustor passes away.
