What is a durable power of attorney for healthcare?
A durable power of attorney for healthcare (DPOA-HC) is a legal document that allows an individual to appoint someone else to make healthcare decisions on their behalf in case they become unable to do so. This type of power of attorney is only valid in the state of New Mexico, and it is designed to help individuals make sure that their wishes regarding medical care are followed, even if they are unable to communicate them. The DPOA-HC grants the appointed person the power to make all types of health care decisions for the person they are representing. This includes decisions about treatments, such as surgeries or medications, as well as end-of-life decisions and other healthcare related issues. The person appointed in the DPOA-HC must be someone that the individual trusts to respect and act on their wishes. This is especially important since the appointed person will have the authority to make healthcare decisions for them, and the decisions they make could have a significant effect on the individual’s life. It is important to note that the DPOA-HC will only be valid in New Mexico, so if the individual plan to move to another state it will not be valid there. In New Mexico, the DPOA-HC must be signed in front of two adult witnesses and it must be notarized in order to be valid. Once it has been created, the document can be updated or revoked at any time, as long as the individual is still able to make decisions for themselves.
