What is a durable power of attorney for healthcare?

A Durable Power of Attorney for Healthcare (DPOAHC) is a legal document that allows an individual to designate someone else to make health care decisions on their behalf if they become incapacitated and are unable to make decisions for themselves. With a DPOAHC, an individual can grant their chosen agent the authority to make decisions regarding their health care and medical treatments, including the revocation or approval of specific treatments. This document is usually signed by both the principal — the individual granting the authority — and the agent — the individual receiving the authority. In South Carolina, a DPOAHC must meet certain legal requirements. To be valid, the power of attorney must include specific language, such as a statement that the document is durable, meaning it remains valid and in effect even if the principal becomes incapacitated. Additionally, the document must be in writing and witnessed either by two adults or a notary public, and the principal must be of sound mind when signing the document. DPOAHCs are an important document for individuals who wish to have control over their medical care and treatment if they become incapacitated. It gives individuals the chance to create a plan for their healthcare decisions and to have a trusted individual act on their behalf if the need arises.
