What is the difference between a tire defect and a tire failure?
The difference between a tire defect and a tire failure in Washington is that a tire defect occurs when a tire does not meet the standards set by the manufacturer, while a tire failure is when a tire fails due to improper maintenance, installation, wear, or other outside factors. Tire defects could include anything from a manufacturing defect in the rubber or the design, a defect in the molding, a lack of adequate tread or lack of uniformity in the tread pattern, or any other defect that could render a tire unsafe or substandard. A tire failure occurs when the tire does not meet safety criteria due to an outside factor, such as wear, overexposure to pressure or heat, improper installation, overloading, or a mechanical failure. In Washington, tire defects and failures can be addressed under the Tire Failure Law. This law requires tire manufacturers to replace any tires that have a defect or failure, if the defect or failure occurred due to a manufacturing problem, improper installation, or improper maintenance. If the tire defect or failure was not caused by any of these three issues, the customer can be held responsible for the cost of the replacement tire. Additionally, the customer may be liable for any damages caused by the defect or failure.
