How to prove a tire manufacturer is liable for a tire failure?

In California, a tire manufacturer can be held liable for tire failure if it can be established that the failure was due to a defect or negligence on their part. To prove liability, the plaintiff, or party filing the lawsuit, must show that the tire was defective or that the manufacturer was negligent in its design, production, or marketing of the tire. In order to prove the tire was defective, the plaintiff would need to provide evidence of a manufacturing or design defect, such as a puncture in the sidewall, or a flaw in the tread pattern that lead to the tire’s failure. If the defect can be definitively linked to the tire manufacturer, then they may be held liable for the damages. In cases of negligence, the plaintiff must show that the manufacturer did not use reasonable care in designing and producing the tire. This could be shown by demonstrating that the tire did not meet industry standards, or that the manufacturer failed to provide adequate instructions or warnings about the tire’s use and maintenance. In addition to either of the above, the plaintiff would also need to show that the tire failure caused the injury or damage in question. This includes demonstrating that the tire manufacturer’s negligence or defect was the proximate cause of the injury. If they can prove all of the above, then the tire manufacturer may be held liable for the damages resulting from the tire’s failure.
