What is a trademark?

A trademark is a distinctive sign or symbol which is used by a business to identify and distinguish itself from other businesses. It is generally a word, phrase, logo, design, or combination of any of these elements, and is used on products and services to make them recognizable to consumers. In Tennessee, trademarks are regulated and enforced by state and federal laws. Trademark law protects the trademark and prevents others from using it without the permission of its owner. The trademark symbol – the ™ or ® – helps consumers to easily identify the source of the product or service, and also signals other businesses and individuals that the trademark is legally owned by somebody else. Trademark infringements are taken seriously in Tennessee and can result in big fines and penalties. As a business owner, trademark registration is important because it gives you exclusive rights to use the trademarked symbol or name, and prevents others from taking it away or using it without your permission. It also helps to ensure that your brand and identity are protected and recognized in the marketplace.
