How do I register a trademark?
To register a trademark in New York, the first step is to conduct a trademark search. This will help to ensure that the trademark you want to register is not already taken or too similar to other existing trademarks. Once you have confirmed that the trademark is available, you will need to complete a Trademark Application form and submit it to the United States Patent and Trademark Office (USPTO). The application form will require information about the mark, such as the name, description, and goods or services it applies to. After submitting the form, the USPTO will review your application. This review usually takes about three months, and during this time, they will examine the trademark to ensure that it is not confusingly similar to any other existing trademarks. If they approve your application, you will receive a Notice of Publication and your trademark will be listed in the Official Gazette. The next step is to monitor the trademark. This process involves hiring an attorney to watch for any possible challenges to the trademark. If someone does challenge your trademark, you’ll have to respond to the challenge by filing a notice of opposition. If the USPTO finds that the challenge is valid, your trademark will not be registered. If the challenge fails, however, your trademark will be registered for up to 10 years. After registering your trademark, you will need to renew it every 10 years to keep it in effect. To do this, you must submit a renewal form to the USPTO to maintain your exclusive rights to the trademark.
