What types of trademarks can I register?
In Massachusetts, you can register any type of trademark you want as long as it does not infringe on the trademarks of another. A trademark is typically a logo, phrase, word, or design that allows customers to easily recognize the products and services of a certain company. It can also include certain sounds, smells, or even colors. The simplest type of trademark is a word mark, which is a phrase, company name, or slogan. An example of this would be the phrase “Just Do It” or the company name “Nike”. It is important to note that you can only receive a trademark if it is something that customers would easily recognize and identify as belonging to a specific company. A design mark is another type of trademark. This includes any graphic symbols, logos, or symbols associated with a company. An example of this is the Nike swoosh logo. Lastly, a sound mark is a trademark associated with a sound, such as the MGM lion roaring. You can also receive a collective mark, which is a trademark that is used to identify a membership in a specific organization or group. This is less common than the other types of trademarks, but it is still an option in Massachusetts. Finally, a service mark is a trademark that identifies a service instead of a product. An example of this would be the company name “Yelp” which is used to identifty a service for finding and reviewing restaurants. In order to register any of these trademark types in Massachusetts, you must first apply for registration with the United States Patent and Trademark Office. It is important to note that trademarks can only be registered if they do not infringe on the trademarks of another company.
