What types of trademarks can I register?
In North Carolina, you can register a variety of trademarks, depending on the type of protection you desire. Generally, trademark law distinguishes between three types of marks—trademarks, service marks, and collective marks. A trademark is a distinctive symbol, phrase, word, or design that is used to identify a product or service. For example, Nike’s iconic “swoosh” is a trademark. To be protectable, a trademark must be distinctive – it must not already be used by another company and it must create a distinct impression with consumers. A service mark is similar to a trademark, but it is used to identify a service instead of a product. For example, the United Parcel Service’s logo is a service mark. A collective mark identifies a specific association or organization. For example, the U.S. Navy Seal’s logo is a collective mark. In order to register a trademark, you must submit an application with the United States Patent and Trademark Office (USPTO). The application requires detailed information about the mark and its use, and fees must be paid for the application and any additional services. Once approved, your trademark will be officially registered and legally protected.
