How do I file a trademark application?
In Massachusetts, the first step to filing a trademark application is to find out if your desired trademark is already in use. You can search existing trademark records online through the United States Patent and Trademark Office website. Once you know that the trademark is not currently in use, you will need to fill out an “Application for Registration of a Trademark” form, which can be found online. Next, you’ll need to provide proof of actual use of the trademark for a short description of your goods or services, an example of the trademark used with your goods or services, and the date the trademark was first used. You’ll also need to provide a clear representation of the trademark at the time of filing. You will then need to submit the application form, your supporting materials, and your payment for the filing fee online using the United States Patent and Trademark Office’s Electronic Trademark Filing System. Once your application is accepted, you will receive an official filing receipt. After you’ve filed your trademark application, you’ll have to wait for the registration process to be completed by the United States Patent and Trademark Office. This can take several months. You’ll also have to track the status of your application from time to time and respond to any objections or clarifications that the USPTO requests. Once your trademark is approved, it will be valid for a period of 10 years, after which it must be renewed.
